good wednesday morning to meteorologist christina loren. >> good morning. a live look at oakland, highly visible, no low clouds to get in your way as you drive to work. a touch cooler. big story in the weather department, big waves on the way and potential window for mavericks. we'll jump into the forecast. tracking showers. first, on your way to work. mike inouye. >> good morning. good news, a light traffic flow through oakland. we'll see you the coliseum camera. taillights up through downtown. look at the map. not a big deal at kcoliseum but zoom in southbound. reports of a crash involve league vehicles. sounds like off to the shoulder. slowing has come up to the flashing lights. chp on scene. northbound sideshows slowing. crash on the opposite side and flashing lights visible at that point as well as construction, farther north that's causing more distraction. they've marked the crash there, around 14th or 16th.

that will aban issue coming through downtown. we are learning more about the b.a.r.t. police officer shot and killed by a fellow officer. b.a.r.t. sergeant thomas smith, a 20-year veteran of the force, he's survived by his wife, who also works in department and his 6-year-old daughter. his death the first on-duty fatality in department history. "today in the bay's" bob redell joins us from the apartment complex in dublin where it all happened. officers went in with guns drawn but knew the suspect wasn't home at the time. >> reporter: good morning, la a laura. yes, they knew the person on probation, suspect, was not at home but not sure if there might be anyone else in the unit at the complex in dublin when they play made entry before 2:00, why b.a.r.t. officer thomas smith and several other officers he was with were wearing bulletproof vests and also why they kicked down the door with

their guns drawn. between that entry and the search one of smith's colleagues, a ten-year vert ran of the b.a.r.t. police force fired his gun. that bullet found his way past smith's bulletproof vest, near his armpit, has he had his weapon drawn, entered his body, eventually killed. several members of the law enforcement gathered outside that hospital to salute smith's flag-draped body as it was taken to the coroner's officer. >> condolences goes out to the immediate family and friends and extended b.a.r.t. family and entire b.a.r.t. district. >> reporter: the officer who shot smith, along with all of the other officers on the probation search, were questioned at dublin police office department. it should be known the alameda county sheriff's office is leading the investigation into what happened at complex. overnight, governor brown

offered his condolences and ordered the flag flown at half-staff in smith's honor. myth was 42 lived with his 6-year-old daughter and wife, who also happens to be a b.a.r.t. police officer. live here in dub lip, bob redell, "today in the bay." >> very sad. we are also learning officer smith played a role in the investigation into the deadly shooting of oscar grant. grant, of course, shot and killed by b.a.r.t. police officer in oakland new year's day 2009. since that shooting, the department has enacted reforms, including increased officer training about bias as well as better reporting about incidents using force. attorney john burriss, who represented the grant family, believes procedures will again be the focus in the review of officer smith's death. >> i know that b.a.r.t. police officers go to the academy. i expect the training was proper. that would mean that somewhere else there was a breakdown and i

guess that's what the investigation will determine. >> b.a.r.t.'s police chief says the officers received 40 hours of training every year. the state standard is 24 hours every two years. we will, of course, follow the story, both on air and online. visit nbcbayarea.com for the latest information on this investigation. a developing story in the east bay this morning, oakland police are investigating two deadly shootings involving chp officers that happened less than 24 hour as part. the first shooting on 57th avenue near east 15th street yesterday. an officer shot and killed one man following a short chase. they said he had a gun on him. two other chp officers killed a man at 9:00 on wentworth near bancroft. "today in the bay's" christie smith outside the oakland police department. >> reporter: good morning to you. the second officer involved shooting in as many days in east

oakland. when you take a look at it, similar circumstances, the chp involved. they say it started with a traffic stop in east oakland and they're saying, once again, someone inside of the car had a handgun. this time, they're saying it was a passenger. but police are looking for the car and the driver. they say this started about 9:00 last night, two chp officers in a marked car stopped an suv. according to oakland police, a passenger got out and ran with a handgun visible. the officers let the police canine out and all chased the suspect on foot. they say that the police dog engaged a man and both officers fired. the suspect was hit. so was the canine who is expected to recover. the officers tried to do first aid, cpr, but the man succumbed to injuries, died at the scene. a loaded handgun was recovered and police again, they are still looking for the driver and other

passengers that were in the car. this is a silver late model toyota suv, it had red and white paper plates on it. christie smith, "today in the bay." 4:37. four families waking up in hotel rooms after i fast-moving fire gutted their apartments overnight. crews still not sure how the fire started at the oaks apartments near monterey road and blossom hill road. take a look at video after fire broke out. flames coming out of the second floor apartment. everybody made it out okay. the four families were put up in a hotel for the night. firefighters say they don't know how or where it started. >> i was just scared. >> ever see anything like this before? >>, my first time. >> we had a good stop, being able to keep it to the building of origin and out of the other two units. two units should be habitable quickly, they just had some damage. >> it took firefighters 30

minutes to knock the fire down. waiting to find out what started a separate apartment fire in san jose we first told you about yesterday. "today in the bay." the fire happened on the west side near winchester and hamilton. fire destroyed one unit, led to wart damage for five others. two dozen people temporarily evacuated. power and gas shut off for most of the evening. no one was hurt. one of the four san jose state students charged with a hate crime will be back in court. lawyers expect 18-year-old colin warren to enter a plea on charges he and three others harassed another student because he was black. accused of putting a u-shaped bike lock around his neck. two students, a 19-year-old and 18-year-old have already pleaded not guilty. the fourth student is a minor and his name has not been released. today, governor brown set to deliver the state of the state

address in sacramento. we don't know the details yet but the governor will likely talk about the state's balanced budget, giving additional funding to schools and what he's learned about detroit's bankruptcy case. another possible topic, how to deal with the drought. john boehner will be in the central rally to talk about a fix to the state's water problems. meeting with three republicans, including kevin mccarthy. they will propose an emergency bill that would allow farmers to pump water from the sacramento/san joaquin delta. sacramento is the nation's leader in farming. let's check in with christina loren who has some rain eventually. >> right. we have this cut off low for next week. bull's-eyeing tuesday and wednesday. watching for the first week of february for a significant cooldown and showers and snow on

4:45 on wednesday morning. a group of women will protest several anti-abortion bans are posted in san francisco today. the banners hang above market street in san francisco. today women organized to resist and defend, also known as w.o.r.d., will meet at corner of 4th and market to hold a speakout. the banners were posted for the walk for life group and led lined streets since the day after christmas. last week the supervisor introduced a resolution opposing banners saying they are incorrect and misguided. in washington, d.c., people from across the country will meet at the national mall for the annual march for life. organizers say, despite below freezing temperatures and snow,
